1. Service Description

ChatKasi Pro provides AI-powered WhatsApp Business automation services, including automated customer responses, appointment booking, contact management, and business analytics. Our platform integrates with the WhatsApp Business API through WATI and uses AI language models to generate contextual responses on behalf of your business.

2. Account Registration

To use ChatKasi Pro, you must create an account with valid business information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 18 years old and legally authorised to operate a business in South Africa to use our services.

3. User Responsibilities

  • You must provide accurate and complete business information for AI context configuration.
  • You are responsible for the content of AI-generated responses sent through your WhatsApp Business number.
  • You must comply with WhatsApp Business policies, Meta terms of service, and all applicable South African laws.
  • You must not use the service to send spam, unsolicited messages, or any illegal content.
  • You must ensure your AI configuration does not produce misleading, harmful, or discriminatory responses.
  • You are responsible for obtaining necessary consent from your customers for automated messaging.

4. Subscription Plans and Payment

  • Free Trial: New accounts receive a 14-day free trial with limited message volume.
  • Paid Plans: Solo, Business, and Agency plans are available with different message limits and features.
  • Billing: Subscriptions are billed monthly in South African Rand (ZAR) through Yoco.
  • Cancellation: You may cancel your subscription at any time. Access continues until the end of the current billing period.
  • Refunds: Refunds are handled on a case-by-case basis. Contact support within 7 days of payment for refund requests.
  • Message Limits: Each plan includes a monthly message limit. Exceeding the limit may result in paused automation until the next billing cycle.

5. AI-Generated Content

ChatKasi Pro uses artificial intelligence to generate automated responses. While we strive for accuracy and helpfulness, AI-generated content may occasionally contain errors or inappropriate responses. You acknowledge that you are ultimately responsible for reviewing and managing the AI responses sent to your customers. We recommend regularly monitoring conversations and refining your AI context configuration for best results.

6. Limitation of Liability

To the maximum extent permitted by South African law, ChatKasi Pro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of the service. Our total liability for any claim arising from the service shall not exceed the amount you paid for the service in the 12 months preceding the claim.

7. Service Availability

We strive to maintain high availability of our services but do not guarantee uninterrupted access. Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control, including WhatsApp API outages or third-party service disruptions.

8. Intellectual Property

All intellectual property rights in the ChatKasi Pro platform, including software, design, and branding, remain with ChatKasi Pro. You retain ownership of your business data, AI context configuration, and customer information. You grant us a limited licence to process your data solely for the purpose of providing our services.

9. Termination

We reserve the right to suspend or terminate your account if you violate these terms, engage in fraudulent activity, or use the service in a manner that harms other users or our platform. Upon termination, you may request export of your data within 30 days, after which it may be permanently deleted.

10. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of South Africa. The Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002 apply where relevant.

11. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of significant changes via email or through a notice on our platform. Continued use of the service after changes are posted constitutes acceptance of the updated terms.
